Yes, a car with finance can sometimes be sold in Ireland — but the route depends on the type of finance.
The key distinction is legal ownership. Under hire purchase and PCP, the finance company owns the car until the agreement is completed. With a normal personal loan, the CCPC says you own the car from the start even though you still owe the lender money.
That difference determines whether you can sell freely or need lender permission first.
Start by Identifying the Finance Type
Do not use the phrase “car loan” loosely. Find the agreement and identify whether it is:
- Personal Contract Plan (PCP)
- Hire Purchase (HP)
- personal loan
- another secured or specialist agreement
If you cannot find the paperwork, contact the lender before advertising the car as finance-free.
PCP and HP: You Are Not Yet the Legal Owner
The CCPC states that with both PCP and hire purchase, the finance company owns the vehicle until the final required payment is made.
For HP, the CCPC is explicit that you cannot sell the car without the finance company’s permission.
Its guidance for people having repayment difficulties also notes that a lender may allow a financed car to be sold to clear what is owed — but permission is required.
That means the correct sequence starts with the finance company, not the buyer.
Personal Loan: Different Legal Position
If you borrowed money through a personal loan and used it to buy the car, the CCPC says you own the car from the start.
You can generally sell the car because the lender does not own it under an HP/PCP structure. The loan does not disappear when the car is sold. You remain responsible for repayments unless you use the sale proceeds to clear it.
Read the exact credit agreement before acting, especially if the loan has unusual security terms.
Ask the Lender for a Settlement Figure
A settlement figure tells you what is required to close the finance at a particular point.
Ask the lender:
- exact settlement amount
- how long the figure is valid
- accepted payment method
- whether a buyer or dealer can pay the lender directly
- when written confirmation of clearance will be issued
- what happens if the sale price is lower than the settlement amount
Do not estimate from the remaining monthly payments. Interest, fees or agreement terms can change the number.
Positive Equity Versus Negative Equity
The sale is easiest to understand when you compare two figures:
Market value of the car versus finance settlement figure.
If the car is worth €20,000 and settlement is €15,000, there is €5,000 of gross value above the settlement before selling costs or negotiation.
If the car is worth €15,000 and settlement is €18,000, you have a €3,000 shortfall. Selling the car does not make that shortfall disappear.
That second situation needs a plan agreed with the lender.
A Private Buyer Needs Proof, Not Promises
The CCPC advises used-car buyers to check for outstanding finance and warns that a car subject to finance can create serious problems, including potential repossession.
A sensible buyer should therefore be cautious when you say, “I will clear it after you transfer the money.”
A stronger process is documented and transparent.
Depending on the lender’s procedure, that can mean:
- obtain the current settlement figure
- explain the finance position before taking a deposit
- agree the lender-approved payment process
- clear the finance as required
- obtain written confirmation
- complete the sale and ownership transfer only when the position is clear
The exact mechanics depend on the finance company. Follow its instructions rather than inventing an informal workaround.
Selling to a Dealer Can Be Simpler
Dealers handle financed trade-ins regularly and may be able to coordinate settlement directly with the lender.
That convenience can make a trade-in or dealer purchase easier than a private sale, particularly when the settlement is high or the car is part of your next purchase.
Convenience still needs documentation. Ask how the settlement will be paid and how any positive or negative equity is shown on the invoice.
Do Not Hide the Finance Position in the Advert Conversation
Outstanding finance is not a small detail to reveal after the buyer travels.
If finance still exists, explain the settlement process before asking for commitment. The buyer may want to run a history check and confirm the position independently.
Transparency does not weaken a legitimate sale. It makes the path clearer.
What If You Are in Financial Difficulty?
Do not rush into an unauthorised private sale.
The CCPC explains several possible routes for HP and PCP agreements, including contacting the lender, potential use of the half rule where its conditions apply, or other arrangements such as voluntary surrender. Those options have different financial consequences.
If repayments are becoming difficult, contact the lender early and consider independent debt advice such as MABS rather than waiting for arrears to decide the strategy for you.
What the Buyer Should Verify
If you are the buyer rather than the seller, check:
- whether finance is recorded against the car
- the seller’s explanation of the agreement
- written settlement evidence
- whether the finance company confirms the clearance route
- that the person selling has authority to complete the transaction
Keep Vehicle History Check Ireland beside the purchase process.
After the Finance Is Cleared
Once the lender position is resolved, the remaining sale should be ordinary and well documented:
- agreed price
- payment evidence
- correct ownership-transfer process
- keys and documents handed over
- sale receipt/invoice where appropriate
The finance should not remain a vague background issue after the car changes hands.
Bottom Line
The answer depends on how the car was financed.
With PCP or hire purchase, the finance company is the legal owner during the agreement, so you cannot treat the car as an ordinary finance-free private asset. Contact the lender, obtain a settlement figure and follow its sale or settlement process.
With a normal personal loan, you own the car, but selling it does not cancel the debt.
The safest sale is the one where the finance position is clear before the buyer pays, not explained afterward.
Once the car is ready to sell cleanly, you can create a structured WazerMart advert.
